Changes to GPs’ sick notes
From 6 April 2010, GPs will be required to issue ‘fit notes’ instead of the current sick notes. The aim of the ‘fit note’ is to facilitate the employee’s return to work. Therefore, GPs will be required to tick one of four conditions, which the employer will be required to take into account in order to facilitate the employee’s return to work.
This change will require employers to significantly modify the way they manage absence from work. It may also increase risks which could result in successful claims for disability discrimination, constructive dismissal or breach of contract.
Employers are encouraged to implement, or where appropriate, review and amend their existing employment documents, HR policies/procedures as well as train managers in order to minimise potential risks.
